Department of Labor guidance confirms that ERISA claims procedures must recognize properly designated authorized representatives, subject to the plan’s reasonable procedures for designation. CMS external-review materials likewise contemplate consumers or their authorized representatives filing certain review requests.

An assignment of benefits to a provider is not automatically the same as authorizing that provider to act for the patient in an appeal.

Questions to answer before the next call or submission
  • Plan’s authorized-representative form/procedure
  • Scope of authority
  • Representative contact information
  • Privacy authorization if separately required
  • Who receives notices
  • Appeal deadline
  • Clinical contact who will supply evidence
  • How to revoke/update the authorization

Ask the plan how to designate the representative

Use the plan’s form or written authorization procedure when one exists. Define what the representative may do—receive notices, request records, submit the appeal, speak with reviewers or all of the above.

A clear authorization reduces the chance that privacy or procedural rules stop a caregiver at the first phone call.

Choose someone who can manage the record

The best representative is not necessarily the person with the loudest voice. They should be able to track deadlines, keep documents organized, understand the denial reason and communicate with the clinic and plan.

For medically complex cases, the patient may still want the prescriber or clinic to supply clinical evidence even if a family member handles the administrative appeal.

Know where communications will go

When a representative is properly authorized, plan communications may be directed to that representative depending on the authorization and procedure. Make sure the patient and representative agree on who is monitoring deadlines and notices.

Revoke or update the authorization if the representative changes so confidential information does not continue going to the wrong person.

Use the source that actually controls your case

MedicineCostHelp can organize the problem, but the member-specific plan, Medicare program, provider billing record or assistance program makes the actual decision. Save written determinations and reference numbers so the next person does not have to reconstruct the case from scratch.
